Senate Bill 358 (SB 358) increases the fine for trespass.

Senate Bill 358 (SB 358) amends Sections 30-14-1 and 30-14-1.1 NMSA 1978 by increasing the financial penalties for the various types of trespass (criminal trespass, remaining on the land of another after having been requested to leave, entering upon the land of another with posted signs, and driving on another’s fenced land).

Under this bill, the penalty for trespass remains a misdemeanor, yet the bill specifies that the fine can be up $2,500. The judge can impose up to one year in jail, the fine, or both imprisonment and fine.
