HB 272 provides that no later than January 1, 2022, the Taxation and Revenue Department, the Department, which means the Department of Human Services, and the Exchange, which means the New Mexico Health Exchange, shall provide for the establishment and implementation of the "Easy Enrollment Program" to:
(1) determine whether a taxpayer is uninsured; and (2) conduct outreach to uninsured taxpayers to facilitate enrollment in a free or low-cost health insurance plan.
A taxpayer may give consent to the Taxation and Revenue Department to provide the taxpayer's insurance-relevant information to the human services Department and the exchange for the purpose of determining eligibility for enrollment in a program offered by the department's medical assistance division, Medicare or a health insurance plan available through the exchange and notifying the taxpayer of such eligibility. The secretary of taxation and revenue shall revise the state income tax form to permit a taxpayer to provide consent to provide that information to the Department and the exchange by marking a check box on the form.
Upon receipt of the taxpayer's insurance-relevant information, the Department and the exchange shall determine the taxpayer's eligibility for a program provided by the medical assistance division of the department, Medicare or a health coverage plan available through the exchange. If the insurance-relevant information is insufficient to determine eligibility, the Department or the exchange shall contact the taxpayer to request additional information.
The Department shall notify the taxpay regarding the taxpayer's eligibility for the appropriate program offered by the Income Support Division of the Department and the notify the taxpayer that they may be eligible for Medicare. If the taxpayer is not eligible for either, they will be referred to the Exchange including the premium cost and plan description. If the taxpayer notifies the Exchange that they are interested then a time line for enrolling is offered and the opportunity for tax credit on the purchase of their insurance plan is provided.
If the taxpayer enrolls the Exchange is to ensure that coverage begins with in a reasonable time period, that the taxpayer notify the Exchange about changes in household circumstances and that the taxpayer has time to enroll in an alternative health insurance plan if the taxpayer chooses.
The Taxation and Revenue Department and the Exchange will promulgate rules for the Easy Enrollment Program.
Access to information is limited by language in Section 7-1-8.8 NMSA 1978 (being Laws 2019), Chapter 87 Section 2, which allows for Information that may be revealed to other state agencies.
New language enhances the Secretary of Human Services with additional information access to include: health-insurance-relevant information, but only for the purpose of determining eligibility for enrollment in a program offered by the Human Services Department's Medical Assistance Division, Medicare or health insurance plans available through the New Mexico health insurance exchange and notifying the taxpayer of such eligibility.
Finally, the Executive Director of the New Mexico Health Insurance Exchange, health-insurance-relevant information, but only for the purpose of determining eligibility for enrollment in a health insurance plan available through the exchange and notifying the taxpayer of such eligibility
