Synopsis:

 House Bill 21 (HB 21) relates to the Public Works Apprentice and Training Act, which requires contributions to apprentice and training programs or to the Public Works Apprentice and Training Fund for all public works construction projects. HB 21 now lists the responsible department as the Workforce Solutions Department. HB 21 also removes all listed exceptions to the rule, from the public works construction projects section.

Analysis:

 House Bill 21 (HB 21) makes changes to the Public Works Apprentice and Training Act, listed under Administration, Section 13-4D-4 NMSA 1978.

HB 21 clarifies that the Public Works Apprentice and Training Act will now be administered by the Public Works Bureau of the Labor Relations Division of the Workforce Solutions Department.

•	Removed: all references to the act being administered by the Public Works Bureau of the Labor and Industrial Division of the Labor Department.

HB 21 also removed all of the public works construction projects exceptions to the rule, currently listed under the Public Works Apprentice and Training Act, as follows:

•	Removed: street, highway, bridge, road, utility or maintenance contracts with employers who elect not to participate in training.

This changed section will now read as: 

•	Public Works Construction Projects will not be constructed unless an employer agrees to make contributions to approved apprentice and training programs in New Mexico in which the employer is a participant or to the Public Works Apprentice and Training Fund administered by the Public Works Bureau of the Labor Relations Division of the Workforce Solutions Department.
