Summary:
 House Bill 415, relating to employment law, provides that when the use of earned sick leave is not foreseeable, an employee shall notify the employer orally or in writing pursuant to the written policy of the employer. 
Legislation Overview:
 House Bill 415 amends Employment Law code in Earned Sick Leave Subsection E to specify that when the use of earned sick leave is not foreseeable, the employee shall notify the employer orally or in writing pursuant to the written policy of the employer. Previously, the employee was required to notify the employer “as soon as practicable”. 
Current Law:
 House Bill 415 Section 50-17-3 NMSA 1978 (being Laws 2021, Chapter 131, Section 3) currently requires notice of use of earned sick leave as soon as practicable. 
Amendments:
 House Bill 415 is amended by the Commerce Committee& Economic Development Committee 
to add directions regarding notice of not foreseeable sick leave as follows:
In SECTION 1 regarding EARNED SICK LEAVE, Subsection E, which requires that when the use of sick leave is not foreseeable, the employee shall notify the employer pursuant to the written policy or in the absence of a written policy, as soon as practicable.
