Summary:
 House Bill 229 (HB 229) amends sections of public school code by providing specialized support services ancillary to special education. HB 229 provides that school districts and charter schools include specialized support services in department-approved educational plans. 
Legislation Overview:
 House Bill 229 (HB 229) amends sections of public school code to provide ancillary services to special eduction. HB 229 requires school districts and charter schools to include specialized support services in department-approved educational plans.

SECTION 1 amends Public Schools Section 22-8-21 NMSA 1978 (being Laws 1974, Chapter 8, Section 11, as amended) throughout to remove “state board” and replace that term with “department” . Subsection C(5), which provides the number of special education program units, is amended to include specialized support services that meet the requirements provided in Subsection C of Section 22-23-5 NMSA 1978.

SECTION 2 amends Public Schools Section 22-13-5 NMSA 1978 (being Laws 1972, Chapter 95, Section 1, as amended) to add to title: Special Education — Related and Ancillary Services. This section is lettered and charter schools are included with school districts throughout. Subsection C is inserted as follows:
C. Each school district or charter school shall establish within its department-approved educational plan specialized support services ancillary to special education, which are identified through a student’s individualized education program as required for the student to reach full academic potential.

Specialized support services include:
Services provided by medical, behavioral health, or adaptive physical education professionals who are trained and licensed or certified to produce specialized services to an identified student to address issues associated with the student. 

SECTION 3 makes the effective date July 1, 2024. 
Current Law:
 Publics Schools sections do not provide for ancillary services.
