Senate Bill 228 (SB 228) amends Section 30-16-3 and adds a new way to commit the crime of burglary. It provides that it is a crime for a person to enter a retail establishment, after having previously been notified that the person is not allowed into the establishment, with the intent to commit a felony or theft inside. This crime is a fourth degree felony.Current Law:
Currently, burglary consists of the unauthorized entry of any vehicle, watercraft, aircraft, dwelling or other structure with the intent to commit a felony or theft inside. Nonresidential burglary is a fourth degree felony.
