Senate Bill 225 (SB 225) increases the penalties and fines for various offenses. SB 225 increases fines for littering, increases hours of community service for committing graffiti, increases the penalty for the improper use of a travel lane, and increases and provides penalties for violations of the Recycling and Illegal Dumping Act.Legislation Overview:
Senate Bill 225 (SB 225) makes the following changes: • Increases the fine for littering from $50 to $250. • Increases the number of hours of community service for committing graffiti from 100 to 150 hours (when damage from the graffiti is less than $1,000) and from 160 to 200 hours (when the damage is more than $1,000). • Increases the fine for improper use of a travel lane from $250 to $500. • Creates a fourth degree felony for a violation of the Recycling and Illegal Dumping Act if the violation involves illegal dumping. The penalty is a fine of up to $10,000.Current Law:
Currently, the fine for littering is $50; a person who commits graffiti must perform between 100 to 160 hours of community service; and the fine for improper use of a travel lane is $250. Illegal dumping is prohibited under the Recycling and Illegal Dumping Act and any violation of the Act can result in a compliance order, with a fine not to exceed $5,000 per day of noncompliance (Section 74-13-13(B)).Amendments:
On March 12, 2025, the Senate Judiciary Committee amended SB 225 by removing Section 4, which increased the penalty for violations of the Recycling and Illegal Dumping Act. Specifically, Section 4 created a fourth degree felony with up to a $10,000 fine if the violation involved illegal dumping.
