Summary:
 This bill (SB34) expands the presription donar program to both instate and out of state contributors. All presciptions must be reviewed by a medical professional.  
Legislation Overview:
 Synopsis: (SB34) Relating to prescription drugs and expanding the prescription drug donation program to allow more donors and recipients to participate in the donation, collection and redistribution of unused prescription drugs

 Analysis: (SB34)This legislation makes modifications for the redistribution of unused drugs to more donors. Certain definitions are modified such as 
"eligible recipient" which now means a person who registers with the board to participate in the collection of donated drugs and is: (a) licensed pursuant to Section 61-11-14 NMSA 1978 to receive and distribute prescription drugs; (b) a health care facility licensed by the department of health pursuant to the Public Health Act; or (c) a practitioner licensed to prescribe prescription drugs.
The board is to promulgate rules for these modifications. Also, out of state donors are now allowed to donate to eligible recipients and recipients may redistribute the donated prescription drugs. 
Donated prescription drugs shall only be redistributed to a patient if the drugs will not expire before the patient is able to completely use the drugs, based on the directions for use given by the patient's prescribing health care professional.
Donated drugs must be inspected by a health care professional. 
Reasonable costs of participating in the collection of donated prescription drugs may be charged to the patient. Reference to a twenty dollar charge to recipient the original legislation was deleted.
