House Bill 40 (HB 40) requires that adult changing stations be installed in state-funded facilities, to accommodate adults with disabilities. The relevant facilities are defined as “commercial places of public amusement,” such as auditoriums, convention centers, cultural complexes, exhibition halls, permanent amusement parks, sports arenas, theatres, and movie houses, for which the maximum occupancy is determined to be two thousand five hundred or more people. By July 1, 2032, each facility must install and maintain at least one station when the facility is open to the public, and after July 1, 2025, each facility undergoing renovation costing more than $50,000 must install at least one station. Further, any new facilities receiving state funding for construction or operating costs must install at least one station.Amendments:
Amended February 17, 2025 in HCEDC HCEDCa/HB 40: The House Commerce and Economic Development Committee amends House Bill 40 as follows: 1. On page 2, line 2, strike "or" and insert in lieu thereof a comma and before "that", insert "or group of interconnected public buildings or commercial places of public amusement that are located on a single premises". 2. On page 2, line 8, after "department", insert "using visitor data that is tracked by that department". 3. On page 2, line 11, before the semicolon, insert "or rest areas". 4. On page 2, line 19, before "shall", insert "that has a family or gender-neutral bathroom". 5. On page 2, line 22, after the period, insert "A covered facility shall not be required to install a universal adult changing station if the installation would threaten or destroy the historic significance of a historic property."
