House Bill 50 (HB 50) provides that multiple violations of crimes involving stolen vehicles apply towards sentencing regardless of which section of law was violated previously.Legislation Overview:
House Bill 50 (HB 50) amends the crimes of Unlawful Taking of a Vehicle or Motor Vehicle, Embezzlement of a Vehicle or Motor Vehicle, Fraudulently Obtaining a Vehicle or Motor Vehicle, and Receiving or Transferring Stolen Vehicles or Motor Vehicles, by allowing that multiple violations of these crimes apply towards sentencing regardless of which section of law was violated previously.Current Law:
Currently, the penalties for these crimes involving stolen vehicles range from a fourth degree felony for a first offense, a third degree felony for a second offense, and a second degree felony for a third or subsequent offense. HB 50 incorporates the current sentencing scheme; however, in determining the penalty for subsequent offenses, the bill provides that prior violations of any of these crimes count towards sentencing.
