Summary:
 
Senate Bill 153 (SB 153) relates to larceny and removes “dwelling” from aggravated burglary, and enacts a new second degree crime of home invasion.  
Legislation Overview:
 Senate Bill 153 (SB 153) makes two changes relating to the crime of larceny. 
First, SB 153 removes the ability for aggravated burglary to be committed by breaking into a dwelling.  Therefore, aggravated burglary now only can be committed by breaking into a vehicle, watercraft, aircraft or other structure. 
Second, SB 153 enacts the new crime of “home invasion”.  This offense, a second degree felony, is committed when a person unlawfully enters a dwelling while the occupant is inside with the intent to commit a felony or theft in it and the person is either armed with a deadly weapon or after entering, is armed with a deadly weapon, or commits any unlawful act, threat or menacing conduct that causes the other person to believe they are in danger of an immediate battery.   
Current Law:
 Currently, aggravated burglary can be committed by breaking into a dwelling.
