Senate Bill 152 (SB 152) allows counties to petition the Cannabis Control Division of the Regulation and Licensing Department for a moratorium on new cannabis producer licenses.Legislation Overview:
Senate Bill 152 (SB 152) enacts a new section of the Cannabis Regulation Act to read: A. A Board of County Commissioners may vote to petition the Cannabis Control Division (CCD) of the Regulation and Licensing Department (RLD) to impose a two-year moratorium on the issuance of new cannabis producer licenses in that county; if they do so, they must publish a public notice of its petition and notify the CCD. The petition may cover commercial cannabis production for only or both commercial and medical cannabis production. B. The county must submit the petition to the CCD within ten days of approving the petition. The CCD must render its decision on the petition within ten days of receipt of the petition and inform the county of its decision to approve or deny the petition. If the division approves the petition, it may not issue new cannabis production licenses for the two-year period of the moratorium. If the CCD denies the petition, it must include its findings and conclusions in the order of denial. C. The county may petition the CCD to end the moratorium before the two-year period has run if the County Commission determines that the moratorium is no longer necessary.Current Law:
There is currently no stipulation that a Board of County Commissioners may petition to impose a moratorium on the issuance of new cannabis producer licenses in that county.
