Summary:
 House Bill 121 (HB 121) requires the Children, Youth and Families Department (CYFD) to conduct assessments, provide services and conduct an investigation upon a failure to comply with a plan of care. 
Legislation Overview:
 House Bill 121 (HB 121) amends Section 32A-3A-14 NMSA 1978 to require the Children, Youth and Families Department (CYFD) to conduct assessments, provide services and conduct an investigation upon a failure to comply with a plan of care. Under current law, a child’s parents, relatives, guardians or caretakers had the option to decline services or programs without consequence. This act stipulates that if they decline, the CYFD must proceed with an investigation. 
Current Law:
 If the bill does not pass, it will remain an option (rather than a mandate) for CYFD to conduct assessments, provide services and conduct investigations if a child’s parents, relatives, guardians or caretakers fail to comply with a plan of care. Also, there would continue to be no mandatory consequences or follow-up if the child’s caretakers decline the services offered.
